1. SCOPE OF APPLICATION
The following terms and conditions apply to all orders placed through our online shop.
Some conditions of the terms and conditions only apply to you if you are a consumer within the meaning of § 13 of the German Civil Code (BGB). You are a consumer if the acquisition of the products cannot predominantly be attributed to your commercial or independent professional activity. We expressly point out the limited applicability of the regulation in each individual case.

2. CONTRACT PARTNER, CONCLUSION OF CONTRACT
The purchase contract is concluded with FREYA ESTEPHAN B.V.
By listing the products in the online shop, we make a binding offer for the conclusion of a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the ordering process. The contract is concluded by clicking the order button to accept the offer for the goods contained in the shopping cart. Immediately after submitting the order, you will receive a confirmation by email.
A binding contract can also be concluded earlier as follows:
If you have chosen credit card payment, the contract is concluded at the time of the credit card charge.
If you have chosen the payment method PayPal, the contract is concluded at the time you confirm the payment instruction to PayPal.
The languages available for the conclusion of the contract are German and English.
We store the contract text and send you the order details and our terms and conditions by email. You can view the terms and conditions at any time here on this page. Your past orders are no longer accessible online for security reasons.

3. DELIVERY TERMS
In addition to the stated product prices, shipping costs may apply. (You can find out more about the amount of shipping costs in the offers.) We process incoming orders on weekdays within 48 hours and then ship them with DHL, DPD, UPS, or FedEx. Our standard shipping takes a total of 2 to 5 days within the EU and 6 to 8 days outside the EU.
We deliver to parcel stations.
In the EU, shipping is offered to the following countries: Belgium, Bulgaria, Denmark, Germany, Estonia, Finland, France, Greece, Great Britain, Ireland, Italy, Croatia, Latvia, Lithuania, Luxembourg, Netherlands, Austria, Poland, Portugal, Romania, Sweden, Slovakia, Slovenia, Spain, Czech Republic, Hungary. Additionally, we also ship our products to most countries outside the EU.

4. PRICES AND SHIPPING COSTS
(1) The prices on the seller's website include the currently applicable value-added tax. according to § 19 UStG.
(2) The seller informs the customer about possible shipping costs and additional costs for e.g. gift wrapping during the ordering process, before the order is placed. The customer bears the shipping costs and additional costs displayed during the ordering process. Shipping costs may vary depending on the destination country. 5. PAYMENT
The following payment methods are available in our shop:

Credit card
The charge to your credit card occurs upon completion of the order.

PayPal
You pay the invoice amount via the online provider PayPal. You must generally be registered there or register first, authenticate with your access data, and confirm the payment instruction to us. Further information will be provided during the ordering process.

6. RETENTION OF TITLE
The goods remain our property until full payment has been made.

7. TRANSPORT DAMAGES
If goods are delivered with obvious transport damages, please report such errors as soon as possible to the carrier and please contact us immediately. The failure to make a complaint or contact has no consequences for your statutory rights and their enforcement, especially your warranty rights. However, you help us to assert our own claims against the carrier or transport insurance.

8. WITHDRAWAL INSTRUCTION
Right of withdrawal
Within the EU, you have the right to withdraw from this contract within 15 days without giving any reasons. The withdrawal period is 15 days from the day you or a third party named by you, who is not the carrier, have taken possession of the goods. To exercise your right of withdrawal, you must inform us (FREYA ESTEPHAN B.V.) of your decision to withdraw from this contract by means of a clear statement (e.g., email). You may use the attached sample withdrawal form for this purpose, but it is not mandatory. To meet the withdrawal deadline, it is sufficient that you send the notification of the exercise of the right of withdrawal before the withdrawal period expires.
Consequence of withdrawal
If you should withdraw from this contract, we will refund all payments made by you. This will be done without undue delay and in any case no later than 14 days after receiving the goods returned by you or proof that the goods have been sent back to us by you. The costs for the initial delivery as well as returns are excluded from the refund. For this repayment, we will use the same payment method that you used for the original transaction, unless something else has been expressly agreed with you; in no case will you be charged fees for this repayment. We may withhold the repayment until we have received the goods back or until you have provided proof that you have sent the goods back, whichever is the earlier date. You must return or hand over the goods to us without delay and in any case no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period has expired. You are only liable for any loss in value of the goods if this loss in value is due to handling them in a way that is not necessary for checking their nature, characteristics, and functioning.

Exemption from the right of withdrawal
The right of withdrawal does not apply in the following cases: A) The delivery of non-prefabricated goods that are made according to the individual choice or decision of the consumer or that are clearly personalized. B) The delivery of sealed goods that have been opened after delivery and are therefore not suitable for return for health and hygiene reasons.

9. WARRANTY AND GUARANTEES
Unless expressly agreed otherwise below, the statutory liability for defects applies.
The limitation period for claims for defects for used goods is one year from the delivery of the goods.
The above restrictions and deadlines do not apply to claims for damages caused by us, our legal representatives, or vicarious agents
in the event of injury to life, body, or health
in the event of intentional or grossly negligent breach of duty as well as deceit
in the event of a breach of essential contractual obligations, the fulfillment of which enables the proper execution of the contract and on which the contractual partner may regularly rely (cardinal obligations)
within the framework of a guarantee promise, as far as agreed
as far as the scope of the Product Liability Act is opened.
FREYA ESTEPHAN is not liable for defects in the goods that are solely due to your improper or unsuitable storage of the goods. The regulation of § 477 BGB remains unaffected, i.e., if you are a consumer and such a defect appears within six months after the transfer of risk, i.e., after the goods have been delivered to you or you have fallen into default of acceptance (§ 446 BGB), we must prove that the defect is based on your improper or unsuitable storage of the goods. If we fail to do so or if the cause of the defective condition or the time of occurrence of this cause remains unclear, the presumption applies in your favor that the defect was already present at the time of delivery or at the time of the default of acceptance. This does not apply if the presumption is incompatible with the nature of the goods or the defect.
FREYA ESTEPHAN is also not responsible for damages to items transported or stored in the goods if these are solely due to improper use of the goods.

10. LIABILITY
For claims due to damages caused by us, our legal representatives, or vicarious agents, we are always fully liable.
in the event of injury to life, body, or health,
if the cause of the damage is based on intentional or grossly negligent behavior,
to the extent of a guarantee assumed by us,
in the case of fraudulent concealment of defects, as well as
as far as the scope of the Product Liability Act is opened.
For slight negligence on our part, our legal representatives, or agents, we are only liable for the breach of essential contractual obligations, the fulfillment of which makes the proper execution of the contract possible in the first place and on which the contractual partner may regularly rely (cardinal obligations). In this case, our liability is limited to the foreseeable damage at the time of the conclusion of the contract, which must typically be expected to occur.
Furthermore, our liability – including for fulfillment and vicarious agents – is excluded.

11. DISCOUNT CODES
(1) Multiple discount codes cannot be combined for a single purchase.
(2) Discount codes cannot be used for already reduced goods.

GIFT CARDS
(1) The purchase of a gift voucher is final. Gift vouchers are excluded from exchange.
(2) Gift vouchers are valid for three years from the date of purchase.
