  1. SCOPE OF APPLICATION
    The following terms and conditions apply to all orders placed through our online shop.
    Some conditions of the terms and conditions only apply to you if you are a consumer within the meaning of § 13 of the German Civil Code (BGB). You are a consumer if the purchase of the products cannot predominantly be attributed to your commercial or independent professional activity. We explicitly point out the limited applicability of the regulation in each individual case.

  2. CONTRACT PARTNER, CONCLUSION OF CONTRACT
    The purchase contract is concluded with FREYA ESTEPHAN B.V.
    By listing the products in the online shop, we make a binding offer for the conclusion of a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the ordering process. The contract is concluded by clicking the order button to accept the offer for the goods contained in the shopping cart. Immediately after submitting the order, you will receive a confirmation by email.
    A binding contract can also be concluded earlier as follows:
    If you have chosen credit card payment, the contract is concluded at the time of the credit card charge.
    If you have chosen the payment method PayPal, the contract is concluded at the time you confirm the payment instruction to PayPal.
    The languages available for the conclusion of the contract are German and English.
    We store the contract text and send you the order data and our terms and conditions by email. You can view the terms and conditions at any time here on this page. Your past orders are no longer accessible online for security reasons.

  3. TERMS OF DELIVERY
    In addition to the listed product prices, shipping costs may apply. (You can find out more about the amount of shipping costs in the offers.) We process incoming orders on weekdays within 48 hours and then ship them with DHL, DPD, UPS, or FedEx. Delivery times vary depending on the destination country, shipping method, and customs clearance. Within Europe, delivery usually takes place within a few working days. For international shipments, delivery times may be longer. We deliver to parcel stations. We deliver within the European Union as well as to most international destination countries worldwide. For deliveries outside the European Union, additional duties, taxes, or import fees may apply. These are to be borne by the buyer.

  1. PRICES AND SHIPPING COSTS
    (1) All prices include the applicable statutory value-added tax.
    (2) The seller informs the customer about possible shipping costs and additional costs during the ordering process, before the order is placed. The customer bears the shipping costs and additional costs displayed during the ordering process. Shipping costs may vary depending on the destination country.   2. PAYMENT
    The following payment methods are available in our shop:

Credit card
Your credit card will be charged upon completion of the order.

PayPal
You pay the invoice amount through the online provider PayPal. You must generally be registered there or register first, authenticate with your access data, and confirm the payment instruction to us. Further instructions will be provided during the ordering process.

Shopify Payments
Payment processing is done through Shopify Payments. You will receive more information during the ordering process as well as in the privacy policy of the respective payment service provider.

Klarna
When selecting a Klarna payment method, the payment processing is done through Klarna. You will receive more information during the ordering process.

  1. RETENTION OF TITLE
    The goods remain our property until full payment is made.

  2. TRANSPORT DAMAGE
    If goods are delivered with obvious transport damage, please report such errors as soon as possible to the carrier and contact us immediately. The failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, especially your warranty rights. However, you help us to assert our own claims against the carrier or transport insurance.

  3. RETURNS, EXCHANGES, AND REFUNDS

    You can return items within 15 days of receiving your order.

    To initiate a return, please use the "View Order" button in your order confirmation or fill out the return form on our website.

    For each order, we provide a prepaid return label. The return shipping costs will be deducted from the refund amount.

    If an item arrives damaged or defective, we will of course cover the return shipping costs and refund the full purchase price.

    If you would like to receive an item in a different color or size, please return the original item and reorder the desired variant.

    Returned items must be in unworn and perfect condition. We reserve the right to refuse returns or to claim a reasonable compensation for value if the goods have been used beyond the usual examination of quality, characteristics, and functionality.

    After receiving and inspecting your return, the refund will be processed to the original payment method used. Refunds are generally processed within 7 business days. Once the refund has been initiated, you will receive a corresponding confirmation via email.

    Personalized or custom-made items are excluded from return.

     

  1. WARRANTY AND GUARANTEES
    Unless expressly agreed otherwise below, the statutory liability for defects applies.
    The above restrictions and time limitations do not apply to claims for damages caused by us, our legal representatives, or vicarious agents
    in the event of injury to life, body, or health
    in the event of intentional or grossly negligent breach of duty as well as deceit
    in the event of a breach of essential contractual obligations, the fulfillment of which enables the proper execution of the contract and on which the contracting partner may regularly rely (cardinal obligations)
    within the framework of a warranty promise, as agreed
    as far as the scope of the Product Liability Act is opened.
    FREYA ESTEPHAN is not liable for defects in the goods that are solely due to your improper or unsuitable storage of the goods. The provision of § 477 BGB remains unaffected, i.e. if you are a consumer and If such a defect becomes apparent within the statutory presumption period after the transfer of risk, i.e., after the goods have been delivered to you or you have fallen into default of acceptance (§ 446 BGB), we must prove that the defect is due to your improper or unsuitable storage of the goods. If we fail to do this or if the cause of the defective condition or the timing of the occurrence of this cause remains unclear, the presumption shall apply in your favor that the defect was already present at the time of delivery or at the time of the occurrence of the default of acceptance. This does not apply if the presumption is incompatible with the nature of the goods or the defect.
    FREYA ESTEPHAN is also not responsible for damages to items transported or stored in the goods if these are solely due to improper use of the goods.

  2. LIABILITY
    For claims due to damages caused by us, our legal representatives, or vicarious agents, we are always fully liable in the event of injury to life, body, or health,
    if the cause of the damage is based on intentional or grossly negligent behavior, to the extent of a guarantee assumed by us,
    in the case of fraudulent concealment of defects, as well as to the extent that the scope of the Product Liability Act is opened.
    For slight negligence on our part, our legal representatives, or vicarious agents, we are only liable for the breach of essential contractual obligations, the fulfillment of which makes the proper execution of the contract possible in the first place and on which the contractual partner may regularly rely (cardinal obligations). In this case, our liability is limited to the foreseeable damage at the time of the conclusion of the contract, the occurrence of which must typically be expected.
    Furthermore, our liability – including for vicarious agents – is excluded.

  3. DISCOUNT CODES
    (1) Multiple discount codes cannot be combined for a single purchase.
    (2) Discount codes cannot be used for already reduced goods.

  4. GIFT CARDS
    (1) The purchase of a gift voucher is final. Gift vouchers are excluded from exchange.
    (2) Gift vouchers are valid for three years from the date of purchase.

SAVING CLAUSE
If individual provisions of these terms and conditions are wholly or partially ineffective, the validity of the remaining provisions shall remain unaffected. The ineffective provision shall be replaced by the respective statutory regulation.
